Resigning does not cut gratuity
If I resign instead of being terminated, do I lose part of my gratuity?
The situation
Resignation does not reduce statutory gratuity. Loss applies only to dismissal for an Art. 61 reason.
The law
- Art. 54, Labour Law No. 14 of 2004: Gratuity of at least three weeks of last basic wage for each year after one full year of service, pro rata for part years
- Labour Law No. 14 of 2004: Main private sector employment law
What it means for you
A worker who resigns after 5 years on QAR 7,000 basic still gets at least 7,000 x 12 / 52 x 3 x 5 = QAR 24,231. Give the notice required by the contract and law so the exit is clean.
What to do
- Give proper notice.
- Ask HR for the calculation.
- Check it uses the last basic wage.
- Sign only after payment.
