Contract gives more than the law
My contract promises one month per year. The company offers three weeks. Who is right?
The situation
The law sets a floor of three weeks per year; a more generous contract term applies.
The law
- Art. 54, Labour Law No. 14 of 2004: Gratuity of at least three weeks of last basic wage for each year after one full year of service, pro rata for part years
- Labour Law No. 14 of 2004: Main private sector employment law
What it means for you
On QAR 9,000 basic for 6 years, one month per year gives QAR 54,000, while the legal floor of three weeks per year is about 9,000 x 12 / 52 x 3 x 6 = QAR 37,385. The contract amount applies because it is more generous. Ask for the higher figure in writing.
What to do
- Read the contract clause.
- Compute both amounts.
- Ask for the higher amount in writing.
- Escalate to MOL if refused.
