Employee waiving gratuity
An employee offered to give up gratuity in return for a quick release. Is that valid?
The situation
Under Art. 4 of the Labour Law, waivers of statutory rights are void.
The law
- Labour Law No. 14 of 2004: Main private sector employment law
- Art. 54, Labour Law No. 14 of 2004: Gratuity of at least three weeks of last basic wage for each year after one full year of service, pro rata for part years
What it means for you
Even a signed waiver will not protect you if the worker later claims. Pay at least the legal gratuity. Any extra deal must sit on top of statutory dues, not replace them.
What to do
- Do not accept waivers of statutory dues.
- Pay the legal gratuity.
- Document any extra agreement separately.
- Keep the receipt.
