Leaving before one year of service
I am leaving after 10 months. Will I get any gratuity?
The situation
Statutory gratuity is due only after one full year of service.
The law
- Art. 54, Labour Law No. 14 of 2004: Gratuity of at least three weeks of last basic wage for each year after one full year of service, pro rata for part years
What it means for you
With 10 months of service no statutory gratuity is due. You may still be owed unpaid salary, leave pay and any contract benefits. Check the contract, which can be more generous than the law.
What to do
- Check your contract for any better benefit.
- Claim unpaid salary and leave.
- Ask for a written final statement.
- Keep payslips.
