Staff settlement before closure
What must we do for staff before closing?
The situation
Final dues are payable by the next working day after contract end, and residence permits must be cancelled or transferred.
The law
- Art. 67, Labour Law No. 14 of 2004: Final dues payable by the end of the working day after the contract ends; up to seven days if the worker left without notice
- Law No. 21 of 2015 on entry, exit and residence of expatriates: Residence permits are tied to a recruiter or employer and handled by the Ministry of Interior
What it means for you
Final dues are due by the end of the next working day after each contract ends. After paying, cancel or transfer each worker's residence permit through MOI. The Establishment ID cannot be closed while permits remain active, which holds up the whole closure.
What to do
- Compute final dues.
- Pay on time.
- Cancel or transfer permits.
