Golden visa and UAE tax residency
Will my golden visa automatically make me a UAE tax resident?
The situation
No. UAE tax residence for individuals depends on tests such as 183 days of presence, or 90 days with a residence permit and a permanent home or job in the UAE, or having your main home and centre of interests here.
The law
- Cabinet Decision 85 of 2022 on tax residency: Tests for natural persons to be UAE tax resident
What it means for you
A golden visa helps with the 90-day test because you hold a residence permit, but you still need the days and the home or job. Example: a golden visa holder who spent 100 days in Dubai with a rented flat may qualify for that 12-month period. India may still treat you as resident under its own law; that is an India question for the India team.
What to do
- Count your days in the UAE for the period.
- Keep your lease and visa copies.
- Apply for a tax residency certificate on EmaraTax.
- Ask the India team about Indian residence status.
