Foreigner on Employment Pass registering a business
I hold an Employment Pass. Can I register a sole proprietorship?
The situation
EP holders generally need MOM permission to run a business on the side. Pass conditions matter more than ACRA registration.
The law
- Employment of Foreign Manpower Act 1990: Foreign employees need a valid work pass; levies apply to Work Permit and S Pass holders
- Business Names Registration Act 2014: Sole proprietors and partnerships register with ACRA before starting business
What it means for you
Starting a side business without approval can breach your pass terms and risk the pass. Some founders use a company with a resident director instead. Check MOM's rules and get approval in writing.
What to do
- Read your pass conditions.
- Ask MOM about permission.
- Choose the structure.
- Register only after approval.
