Omani staff and gratuity

Do Omani employees get end of service gratuity like expatriates?

The situation

The MOL circular on gratuity covers workers not covered by the Social Protection Law. Omani employees are covered by the Social Protection Fund pension system.

The law

  • Social Protection Law, Royal Decree 52/2023: Omani staff: employer 14.5 percent, employee 8 percent; ceiling OMR 3,000 for pension and injury; pay by the 15th of next month
  • Labour Law RD 53/2023 and MOL circular (August 2026) on gratuity: Non-Omanis not under the Social Protection Law: at least one basic wage per year under the new law; old law periods 15 days a year for the first 3 years then one month

What it means for you

For Omanis, retirement benefits come mainly through SPF contributions of 11 percent employer and 7.5 percent employee for pension. Check the contract for any extra benefit. The gratuity rules described here are for workers outside the SPL system.

What to do

  1. Confirm whether the worker is covered by the SPL.
  2. Pay SPF contributions monthly.
  3. Check the contract for extra benefits.
  4. Apply gratuity rules only where they apply.
