Employer registrations after incorporation

We will hire two staff next month. What registrations does the new company need?

The situation

An employer needs an LHDN employer number for PCB and registrations with KWSP for EPF and PERKESO for SOCSO and EIS.

The law

  • Sec 107, Income Tax Act 1967 and Income Tax (Deduction from Remuneration) Rules 1994: Employer deducts monthly tax (PCB / MTD) and pays it by the 15th of the next month
  • Sec 43, Employees Provident Fund Act 1991: Employer and employee contributions paid by the 15th of the next month
  • Employees' Social Security Act 1969: SOCSO contributions for employees, wage ceiling RM6,000 from Oct 2024
  • Employment Insurance System Act 2017: EIS contributions 0.2% employer and 0.2% employee, ages 18 to 60

What it means for you

Register early so the first payroll can be paid on time. Monthly contributions are due by the 15th of the following month, and late payment brings charges. New hires should be notified to LHDN within the set time using the new employee form.

What to do

  1. Register an employer number with LHDN.
  2. Register as an employer with KWSP.
  3. Register with PERKESO for SOCSO and EIS.
  4. Set payroll to pay all four by the 15th.
