Assets not declared in the 2016 amnesty

Saya ikut tax amnesty 2016 tapi ada aset yang belum dideklarasi. Risikonya?

The situation

Under the Tax Amnesty Law, undeclared assets later found can be treated as income, with heavy surcharges.

The law

  • Law 11/2016 on Tax Amnesty: The 2016 amnesty closed in 2017; assets later found that were not declared are treated as income
  • Art 8, Law 6/1983 on General Provisions and Tax Procedures (KUP Law), as last amended by Law 6/2023: A taxpayer may correct a filed return on its own initiative before an audit starts, and may disclose errors during a preliminary evidence examination with a penalty

What it means for you

The 2022 voluntary programme offered a route for this but has ended. Now, take advice on correcting returns and the asset position before the DJP finds it.

What to do

  1. List undeclared assets.
  2. Take advice on the best route.
  3. Prepare evidence of source.
  4. Correct returns where possible.

Surcharges for amnesty participants can be very high.

We can do this for youCorrecting past returns and voluntary disclosure: return correction, disclosure during examination, and why no amnesty is open: IDR 3.500.000
