Premium residency does not replace MISA registration
With premium residency, can I own a company without MISA?
The situation
Premium residency is about residence. Foreign ownership of a Saudi company is governed by the Investment Law, which requires MISA registration before investing.
The law
- Investment Law (Royal Decree M/19, 11 August 2024): Foreign investors register with MISA before investing; licensing replaced by registration
- Premium Residency Law and product rules: Limited (SAR 100,000 a year) and unlimited (SAR 800,000) products plus five newer categories
What it means for you
Keep the two steps separate in your plan. Premium residency may make daily life and travel easier and remove the need for company sponsorship, but the company still registers with MISA and follows Zakat and tax rules based on ownership.
What to do
- Register with MISA.
- Form the company.
- Keep residency conditions met.
