THR deadline and late fine

The situation

THR must be paid no later than 7 days before the worker's religious holiday. Late payment carries a fine of 5 percent of the THR due.

The law

  • Minister of Manpower Regulation 6/2016 on religious holiday allowance (THR): Workers with 1 month or more of service get THR; 12 months or more get 1 month's wage, less get a pro rata share; pay at least 7 days before the holiday
  • PP 36/2021 on wages, as amended by PP 51/2023: An employer that pays THR late pays a fine of 5 percent of the THR due, on top of the THR itself

What it means for you

The fine does not replace the THR; both are owed. Example: THR due IDR 100 million in total paid late means IDR 5 million fine on top. Labour offices often open complaint posts before Lebaran.

What to do

  1. Mark the holiday date.
  2. Pay at least 7 days before.
  3. If late, pay THR and the fine.
  4. Keep proof of payment.

Repeated failure can bring administrative sanctions.
