Late fee is ₹50 a day (₹20 for nil returns), with a cap that depends on turnover. For most small businesses the cap is ₹2,000 per return.

Provisions

Sec 47, CGST Act 2017; Notification 19/2021-CT

Analysis

Sec 47 sets the late fee and Notification 19/2021-CT caps it at ₹500 for nil returns and at ₹2,000, ₹5,000 or ₹10,000 by previous year turnover up to ₹1.5 crore, ₹1.5 to ₹5 crore and above ₹5 crore. Example: a ₹1 crore turnover trader filing 120 days late pays ₹2,000 for that month's GSTR-3B, not ₹6,000. Late fee is paid in cash only. Check the latest notification for any waiver.
